One thing I did notice is the resistor on v1 pin2 is a 20k
it's the one that came with the kit
should be a 22k as per the layout
Could this be the problem and should I change it to a 22k?

Its difficult to tell from the picture and I know its obvious but look where I circled - the cap is not touching the bare resiistor leg is it?

no it's not touching
I've reflowed all the solder joints and redone some wires and still nothing
is it possible that someone trace out the path from the input to the send jack on the layout
I just can't seem to figure it out
I'd be very appreciative
